Nielsen, who was nominated in October, was expected to secure confirmation after clearing a procedural hurdle in a 59-33 vote on Monday evening. Duke was confirmed as deputy DHS secretary in April, but she does not have a close relationship to Nielsen, and several administration officials say Duke has informed the White House she plans to resign once Nielsen takes over.

"Throughout her confirmation process, Ms. Nielsen failed to demonstrate that she would provide the steady, experienced leadership - free from political interference from the White House - that the department needs".

"It has been an honor to serve as the Department's Acting Secretary, and I look forward to working alongside Ms. Nielsen as her deputy as we continue to carry out the DHS mission of safeguarding the American people, our homeland, and our values", she said in a statement.

Nielsen previously served as chief of staff to Kelly and as senior legislative policy director for the department's Transportation and Security Administration (TSA). They also cited concerns about possible White House interference in a recent DHS decision to send home thousands of Nicaraguans and Haitians long granted USA protection.

The Senate confirmed President Donald Trump's pick to lead the Department of Homeland Security Tuesday, almost two months after John Kelly left the agency to be the president's chief of staff.

As DHS secretary, Nielsen will head an agency charged with protecting America's borders, squashing cybersecurity threats and leading the response to natural disasters.

On other topics, Nielsen said she agreed with Kelly that a U.S. -Mexico border wall is unlikely to be a physical barrier from "sea to shining sea".
