Delhi: Minor 4-year-old booked for raping minor classmate

A four-year-old girl was allegedly sexually assaulted by a classmate on the premises of Delhi's Maxfort School in Dwarka.

The Deputy Commissioner of police said legal experts were consulted in this case "since an offense was made out and there was a victim" and a rape case under the Protection of Children from Sexual Offences (POCSO) Act was registered.

The two children, who are kindergarten students of a private school in Dwarka, were referred for counseling, the police said on Thursday.

According to media reports, the four-year-old girl said the boy from her class unbuttoned her trousers and used his fingers to assault her in the classroom and washroom of the school.

"She (the victim) tried pushing him (the juvenile in conflict with law), but could not get away as the other children had left and there was no staff around", the mother stated in her FIR to the police.

As per reports, the girl's mother claimed that she had sent a message to the schoolteacher informing the incident the same night and again on Saturday, however, the school representatives allegedly did not respond.

Victim's paediatrician and a hospital has confirmed the sexual assault.

The parents have accused the school management of negligence and have also alleged that the principal, a teacher and a coordinator offered no help after learning of the incident.

The girl also told them that when the incident took place no staff member was present inside the class.

Though they registered a case, police were unsure how to proceed with the prosecution because of the suspect's age. "We are examining those provisions even as we are handling the matter with the highest degree of sensitivity", Pathak added. "This is due to the teacher's irresponsible behaviour", mother of the victim said.

However, the school authorities denied the allegations of negligence and non-cooperation in the complaint filed by the mother.

Dr. Samir Parikh, the director of Fortis Healthcare's department of mental health and behavioral sciences told Hindustan Times, an Indian newspaper: "We must understand that it is absolutely not possible for a 4-year-old to understand sexual behavior".
