When asked about de la Huerta's allegations, Sgt. Brendan Ryan of the New York Police Department told Variety in a statement, "We are aware of the sexual assault complaints".

De la Huerta, who has appeared in "A Walk to Remember" and the HBO drama "Boardwalk Empire", alleges Weinstein raped her in her apartment on two separate occasions in 2010.

It was in November 2010 that he allegedly raped her for the first time.

Detectives say her story is believable and have corroborated parts of her story.

NYPD Chief of Detectives Robert Boyce elaborated on DiGaudio's remarks in a news conference for reporters Friday, saying, "We would need an arrest warrant to arrest him, so as of right now, we're gathering our evidence". "No doubt", Boyce said. "But we're talking about a 7-year-old case". This happened seven years ago, and we found corroboration along the way. She told the publication that Weinstein then started to kiss her, and after she tried to brush him away, he pushed her onto the bed, with his trousers down, and lifted up her skirt.

When they arrived at her apartment, the actress said he demanded to go inside for a drink.
