Ezekiel Elliott's suspension begins immediately

A federal appeals court has reportedly overturned a district court's decision in the Ezekiel Elliott case today, meaning the 22-year old stud running back's six-game suspension has been reinstated. So should the National Football League reinstate his suspension immediately, he will start serving his suspension on October 22 at San Francisco.

The 5th Circuit Court of Appeals in New Orleans issued a 2-1 ruling to vacate a preliminary injunction that was issued to the NFL Players' Association by a judge in September, Fox News reported. At the time the NFLPA filed the complaint, it was possible the arbitrator could have issued a final decision that was favorable to Elliott.

"If he serves the suspension and then winds up winning the case later on, he can't get those games back", Garafolo said on NFL Network.

On Thursday, the United States 5th Circuit Court of Appeals ruled in the NFL's favor that the district court did not "have subject matter jurisdiction" in the Elliott case after hearing arguments from the National Football League and NFLPA.

As a result, Elliott's suspension will begin effective immediately. In fact, there's significantly more harm now since the Cowboys are nearing the middle of the season.

"That's their argument for why there is irreparable harm, and why this thing should be stayed as the case plays out in the higher courts".

The NFL filed a letter Thursday with U.S. District Court for the Southern District of NY notifying that court of the of the appeals court's decision.

Elliott's representatives have said they didn't drag their feet in providing the National Football League with information.

Elliott's suspension could remain on hold if he seeks a rehearing, known as an en banc petition, Weinstein said.

The 5th Circuit's ruling is essentially a restart on the process.

"I have been saying all along to be careful what he wishes for", Weinstein said. Zeke would be eligible to return for the Cowboys' Thursday night game against the Washington Redskins in Week 13.

"The District Court, therefore, lacked subject matter jurisdiction when it issued the preliminary injunction". Prosecutors in Columbus, Ohio, decided not to pursue the case, citing conflicting evidence.
