Bill Cosby Trial Ends In 'Mistrial'; Prosecutor Says He Will Retry

Excoriated by the defense for charging Cosby in the first place, District Attorney Kevin Steele vowed to put him on trial a second time, saying accuser Andrea Constand supported the decision.

"Imagine it's you being asked to defend age-old accusations - how do you defend that?" he said. "She's entitled to a verdict in this case". Huth alleges that Cosby forced her to perform a sex act on her at the Playboy Mansion in 1974, when she was 15.

The jury failed to reach a unanimous decision on any of the three counts against the comedian, ending the trial without a verdict after a long week of deliberations.

When those allegations against Cosby were pulled back into the light almost 10 years later, the public had a much different reaction.

District Attorney Kevin Steele said immediately that he would seek a retrial.

"How do I describe the judge?" Cosby, who turns 80 in July, is free on $1 million bond. "It has been restored".

Cosby had once been a beloved comedian, starring in the hit television program The Cosby Show. He found success with his "Fat Albert" animated TV show and starred in commercials for Jell-O pudding.

Media outlets are urging a judge to make the names public.

Under questioning from her lawyer, Cosby acknowledged that he had obtained several prescriptions for quaaludes in the 1970s for the objective of offering the powerful sedative to women he wanted to have sex with.

He said one of the most damning pieces of evidence against the man once known as "America's Dad" was the phone call between him and accuser Andrea Constand's mom, Gianna.

Quaalude was a highly popular party drug in the 1970s that was banned in the 1982.

As one of six alternates, Mike McCloskey was in the courtroom for the trial, but didn't deliberate with the 12 jurors. Judge Steven O'Neill granted the request to choose the jury in Allegheny County and would have to agree to do so again, Stanley said.

"If the parties previously agreed to stay the civil litigation pending the criminal trial, it is likely that they will continue that stipulation for a retrial", said Priya Sopori, a partner at Greenberg Glusker.

Media organizations including The Associated Press are seeking the jurors' identities.

He reminded prosecutors and the defense that "a mistrial is neither vindication nor victory for anybody".

The jury must come to a unanimous decision to convict or acquit. Those cases continue to go forward, though they could be delayed as Cosby may not be required to give depositions in several of them until after the retrial.

Two women jurors who appeared to be in their 30s or 40s looked anguished when they announced the final deadlock, wiping away tears with tissues handed to them by a sympathetic young man sitting between them.

Cosby was eventually charged in December 2015, just days before the statute of limitations was set to expire.

"She's just looking for justice I believe, so it's really sad for her", McCloskey said.

The inability of a court to convict Mr Cosby, 79, has become a rallying point for assault victim activists.
